Q. When the Examiner makes RR?
A. Any time before final action, but usually made in first Office Action (OA).
Q. When should I reply for RR?
A. You should reply within 60Ds after mailing.
Q. What kinds of RR exist?
A. There are three kinds of RR, namely Restriction (in claims), Elections of Species (in specification), and Unity of Invention Requirement (PCT).
Q. When RR is proper?
A. When the claims are “Independent” or “Distinct”. “Independent” means “completely unrelated” and “Distinct” means “somehow related, but separate”. In addition, if there is a serious burden in the Examiner (e.g., separate classification/status in the art or different field of search), RR is proper.
